Judge Matthews had imposed the sentence and therefore was the proper judge to review the sentence.


In the meantime, Sheedy had got rid of his original solicitor and employed a new one, Michael Staines. Michael Staines had never met Philip Sheedy nor had he received instructions on any aspect of the case.

One day he received a call from Michael Quinlan, the Court Registrar, telling him to get an application in on behalf of Philip Sheedy to have the case relisted.

Michael Quinlan told Staines that Cyril Kelly would be reviewing the sentence in the relisted case in Court 24. However, Judge Matthews had imposed the sentence and therefore was the proper judge to review the sentence.
